Terms of Service

1. Acceptance of Terms

By accessing and using Frame.AI (the "Service"), operated by ProtonMob, you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Eligibility

You must be at least 18 years old to use Frame.AI. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration

To use certain features of Frame.AI, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

4. Subscriptions and Billing

4.1 Subscription Plans

Frame.AI offers subscription plans that provide access to AI video generation features. Subscriptions are processed through Apple's In-App Purchase system and are subject to Apple's Terms and Conditions.

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your Apple account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscription through your Apple account settings
• Cancellation takes effect at the end of the current billing period

4.2 Coins (Consumable Purchases)

In addition to subscriptions, Frame.AI offers "Coins" as a pay-as-you-go payment option:

• Coins are consumable in-app purchases processed through Apple's In-App Purchase system
• Coins are used to generate videos when you don't have an active subscription
• Coins do not expire but are non-refundable once purchased
• Coin prices vary based on the AI model and video duration selected
• Once coins are used for video generation, they cannot be refunded

4.3 Pricing Changes

We reserve the right to modify subscription and coin pricing at any time. Price changes will take effect at the start of the next billing cycle. We will provide reasonable notice of significant pricing changes.

4.4 Refunds

All purchases are processed through Apple's In-App Purchase system and are subject to Apple's refund policy. Refund requests should be directed to Apple Support. We do not have the ability to process refunds directly.

Please note:

• Coins are non-refundable once purchased
• Subscription refunds are handled by Apple according to their policies
• Completed video generations cannot be refunded

5. Use License

Subject to your compliance with these Terms, Frame.AI grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal or commercial purposes.

6. User-Generated Content

6.1 Ownership

You retain all ownership rights to the videos you create using Frame.AI. We do not claim ownership of your generated content.

6.2 License to Frame.AI

By using the Service, you grant Frame.AI a limited license to store, process, and display your content solely for the purpose of providing the Service to you.

6.3 User Responsibilities

You are solely responsible for:

• The text prompts and inputs you submit to the Service
• Ensuring your use of generated content complies with applicable laws
• Obtaining necessary rights and permissions for any content you create
• Your use and distribution of generated videos

7. Acceptable Use Policy

You agree not to use Frame.AI to create, upload, transmit, or share content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Infringes on intellectual property rights, privacy rights, or other rights of any person or entity
• Contains personal information of others without their consent
• Depicts, promotes, or facilitates violence, illegal activities, or harm to minors
• Contains malware, viruses, or other harmful code
• Violates any applicable laws or regulations
• Impersonates any person or entity or misrepresents your affiliation
• Interferes with or disrupts the Service or servers

We reserve the right to remove any content that violates this policy and to suspend or terminate accounts of users who violate these Terms.

8. Intellectual Property

The Service, including its original content, features, functionality, and underlying technology, is owned by ProtonMob and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not:

• Copy, modify, distribute, or create derivative works of the Service
• Reverse engineer, decompile, or disassemble the Service
• Remove any copyright, trademark, or other proprietary notices
• Use the Service to develop competing products or services

9. Third-Party Services

Frame.AI uses third-party AI models and services to generate videos. These services are governed by their own terms and conditions. We are not responsible for the availability, accuracy, or performance of these third-party services.

10. Service Availability

We strive to provide reliable service but cannot guarantee uninterrupted or error-free access. The Service may be temporarily unavailable due to:

• Scheduled or emergency maintenance
• Technical issues or server problems
• Third-party service outages
• Events beyond our reasonable control

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Violation of these Terms or our Acceptable Use Policy
• Fraudulent, abusive, or illegal activity
• Failure to pay fees when due
• Extended period of inactivity

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

• The Service will function uninterrupted, secure, or error-free
• Defects will be corrected
• The Service is free of viruses or harmful components
• Results from using the Service will be accurate or reliable

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROTONMOB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or other harmful code that may be transmitted through the Service
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content

14. Indemnification

You agree to defend, indemnify, and hold harmless ProtonMob and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property or privacy rights
• Your generated content

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Turkey.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

• Posting the updated Terms in the app with an updated "Last updated" date
• Providing at least 30 days' notice for material changes
• Sending notifications through the app or email

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the modified Terms.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ProtonMob regarding the Service and supersede any prior agreements.
